External Hosting

This website is hosted by an external service provider (host). Personal data collected on this website are stored on the servers of the host. These may include, but are not limited to, IP addresses, contact requests, metadata and communications, contract information, contact information, names, web page access, and other data generated through a web site.

The host is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of secure, fast and efficient provision of our online services by a professional provider (Art. 6 para. 1 lit. f DSGVO).

Our host will only process your data to the extent necessary to fulfil its performance obligations and to follow our instructions with respect to such data.

Right to data portability

You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfil a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

SSL and/or TLS encryption

For security reasons and to protect the transmission of confidential content, such as purchase orders or inquiries you submit to us as the website operator, this website uses either an SSL or a TLS encryption programme. Right to demand processing restrictions

  • If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data in lieu of demanding the eradication of this data.

If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.

Rejection of unsolicited e-mails

We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in section „Information Required by Law“ to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of promotional information, for instance via SPAM messages.

4. Recording of data on this website

Cookies

In some instances, our website and its pages use so-called cookies. Cookies do not cause any damage to your computer and do not contain viruses. Server log files

The provider of this website and its pages automatically collects and stores information in so-called server log files, which your browser communicates to us automatically. The information comprises:

This data is not merged with other data sources.

This data is recorded on the basis of Art. 6 Sect. 1 lit. f GDPR. The operator of the website has a legitimate interest in the technically error free depiction and the optimization of the operator’s website. In order to achieve this, server log files must be recorded.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a GDPR) and/or on our legitimate interests (Article 6 (1) (f) GDPR), since we have a legitimate interest in the effective processing of requests addressed to us.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Plugins and tools
Firewall

The firewall plugin “Ninja Firewall” from NinTechNet, 38, Soi Ladprao 94, Wang Thonglang, Bangkok 10310, Thailand stores the IP address needed for the firewall to function in anonymized form by removing the last 3 characters. These are stored on our own server for 7 days and then deleted. “Ninja Firewall” protects our website from unauthorized access by unwanted network access. This represents a legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO. No data is transmitted to the developer of the plugin. Cookies: Ninja Firewall uses mandatory authentication cookies to whitelist the administrator. Cookies are set only when an administrator logs into the admin console, they do not apply to visitors of the website protected by NinjaFirewall. 5. Custom Services

Job Applications

We offer website visitors the opportunity to submit job applications to us (e.g. via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g. contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 New GDPR according to German Law (Negotiation of an Employment Relationship), Art. 6 Sect. 1 lit. b GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6 Sect. 1 lit. a GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 New GDPR and Art. 6 Sect. 1 lit. b GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f DSGVO) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6 (1) (a) GDPR) or if statutory data retention requirements preclude the deletion.

 

6. Microsoft Teams

  1. PURPOSE OF PROCESSING

We use the “Microsoft Teams” tool to conduct conference calls, online meetings, video conferences and/or web conferences (hereinafter: “Teams Meetings”). “Microsoft Teams” is a service of Microsoft Corporation.

  1. RESPONSIBLE PARTY

The responsible party for data processing directly related to the implementation of “Teams Meetings” is ICIG Business Services GmbH & Co. KG.

Note: Insofar as you call up the “Microsoft Teams” Internet page, the “Microsoft Teams” provider is responsible for data processing. However, calling up the Internet page is only necessary for the use of “Microsoft Teams” in order to download the software for the use of “Microsoft Teams”.

  1. WHAT DATA IS PROCESSED?

When using “Microsoft Teams”, various types of data are processed. The scope of the data also depends on the data you provide before or during participation in “Teams Meetings”.
The following personal data is processed:

User details:

– Display name (“Display name”),
– e-mail address
– profile picture (optional)
– preferred language
– etc.

Meeting metadata: e.g.

– date
– time of day
– meeting ID
– Phone numbers
– location
– etc.

Text, audio and video data: You may have the option of using the chat function in  “Teams Meetings”. To this extent, the text entries you make will be processed in order to display them in the “Teams Meeting”. In order to enable the display of video and the playback of audio, the data from the microphone of your end device as well as from any video camera of the end device will be processed accordingly for the duration of the meeting. You can turn off or mute the camera or microphone yourself at any time through the “Microsoft Teams” applications.

  1. SCOPE OF PROCESSING.

If we want to record “Teams Meetings”, we will transparently inform you in advance and – if necessary – ask for consent.
Chat content is logged when using Microsoft Teams. Files that users share in chats are stored in the OneDrive for Business account of the user who shared the file. Files that team members share in a channel are stored on the team’s SharePoint site.

Automated decision making as defined in Article 22 of the GDPR is not used.

  1. LEGAL BASIS FOR DATA PROCESSING

As far as personal data of employees of ICIG Business Services GmbH & Co. KG are processed, Section 26 (1) Federal Data Protection Act is the legal basis for data processing. If, in connection with the use of “Microsoft Teams”, personal data is not required for the establishment, implementation or termination of the employment relationship, but is nevertheless an elementary component in the use of “Microsoft Teams”, Art. 6 (1) lit. f GDPR is the legal basis for data processing. In these cases, our interest is in the effective implementation of “Teams meetings”.

For the rest, the legal basis for data processing when conducting “Teams Meetings” is Art. 6 (1) lit. b GDPR, insofar as the meetings are conducted in the context of contractual relationships.

Should no contractual relationship exist, the legal basis is Art. 6 (1) lit. f GDPR. Again, our interest is in the effective conduct of “Teams Meetings”.

  1. RECIPIENTS / DISCLOSURE OF DATA.

Personal data processed in connection with participation in “Teams Meetings” will not be disclosed to third parties as a matter of principle, unless it is specifically intended for disclosure. Please note that, as with face-to-face meetings, content from “Teams Meetings” is often used to communicate information with customers, prospects or third parties and is therefore intended for disclosure.

Other recipients: the provider of “Microsoft Teams” necessarily obtains knowledge of the above data to the extent provided for in our order processing agreement with “Microsoft”.

  1. DATA PROCESSING OUTSIDE THE EUROPEAN UNION.

Data processing outside the European Union (EU) does not occur in principle, as we have limited our storage location to data centers in the European Union. However, we cannot exclude the routing of data via Internet servers that are located outside the EU. This may be the case in particular if participants in “Teams Meetings” are located in a third country.

However, the data is encrypted during transport over the Internet and thus protected against unauthorized access by third parties.

You have the right to obtain information about the personal data concerning you. You can contact us for information at any time.

Furthermore, you have a right to rectification or deletion or to restriction of processing, insofar as you are entitled to this by law.

Finally, you have a right to object to processing within the scope of the law.

A right to data portability also exists within the framework of the data protection legal requirements.

  1. DELETION OF DATA

We delete personal data in principle when there is no need for further storage. A requirement may exist in particular if the data is still needed to fulfill contractual services, to check and grant or ward off warranty and, if applicable, guarantee claims. In the case of statutory retention obligations, deletion will only be considered after expiry of the respective retention obligation.
